1. Acceptance of Terms

Welcome to NIKKS CREATIONS ("we", "our", "us"). These Terms of Service ("Terms") form a binding legal agreement between you ("you", "user") and NIKKS CREATIONS regarding your access to and use of our website (nikkscreations.in) and our mobile applications distributed exclusively through the Samsung Galaxy Store, including PocketWise AI, AI Workout Planner, and CryptChat (collectively, the "Services").

By downloading, installing, accessing, or using any of our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Services.

2. Eligibility

You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction, whichever is higher) to use our Services. By using the Services, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into a binding agreement.

If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Description of Services

NIKKS CREATIONS develops Android mobile applications focused on artificial intelligence, personal productivity, and secure communication. Our current Services include:

• PocketWise AI — an AI-powered personal finance assistant for budgeting, expense tracking, subscription management, and financial insights.
• AI Workout Planner — an AI fitness application that generates personalized workout routines and tracks progress.
• CryptChat — a private encrypted worldwide messaging platform.

We reserve the right to modify, suspend, or discontinue any portion of the Services at any time, with or without notice, and without liability to you.

4. Account Registration

Certain features of the Services require you to create an account. When registering, you agree to provide accurate, current, and complete information, and to keep that information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to safeguard your credentials.

5. Acceptable Use Policy

You agree not to misuse the Services. Prohibited conduct includes, but is not limited to:

• Using the Services for any illegal, fraudulent, or unauthorized purpose.
• Harassing, threatening, defaming, or impersonating any person or entity.
• Transmitting malware, viruses, spyware, or other harmful code.
• Attempting to reverse engineer, decompile, or extract source code from our applications.
• Circumventing, disabling, or interfering with security features.
• Using bots, scrapers, or automated tools to access the Services without authorization.
• Uploading or sharing content that infringes third-party rights or violates applicable law.
• Using the Services to send spam, phishing messages, or unsolicited communications.

Violation of this policy may result in immediate suspension or termination of your account without notice.

6. Subscriptions and Billing

Certain features of our applications may be offered through paid subscriptions. All subscription purchases are processed exclusively through Samsung In-App Purchase (Samsung IAP) via the Samsung Galaxy Store. NIKKS CREATIONS does not directly process, store, or handle payment card information.

By purchasing a subscription, you authorize the Samsung Galaxy Store to charge the payment method associated with your Samsung account on a recurring basis according to the subscription term you selected (e.g., monthly or annually).

Subscriptions auto-renew at the end of each billing cycle unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription at any time through your Samsung Galaxy Store account settings.

Pricing, features, and availability of subscription tiers may change. We will provide reasonable notice of any material changes affecting active subscribers.

7. Refunds and Cancellations

All subscription billing, refunds, and cancellations are handled directly by the Samsung Galaxy Store in accordance with Samsung's policies. NIKKS CREATIONS does not issue refunds directly for purchases made through Samsung IAP.

To request a refund, please contact Samsung Galaxy Store support through your Samsung account. NIKKS CREATIONS has no control over refund decisions made by Samsung.

Cancellation of a subscription will stop future renewals but will not retroactively refund the current billing period unless required by applicable law.

8. AI Disclaimer

Certain features of our Services use artificial intelligence and machine learning models, including third-party AI APIs, to generate content, recommendations, and insights. AI-generated outputs are provided for informational purposes only and may contain inaccuracies, omissions, or unexpected results.

AI outputs do not constitute professional advice of any kind, including medical, legal, financial, fitness, psychological, or therapeutic advice. You should always exercise your own judgment and consult qualified professionals before acting on AI-generated content.

NIKKS CREATIONS makes no warranty regarding the accuracy, completeness, suitability, or reliability of AI-generated content and disclaims all liability arising from your reliance on it.

9. Financial Information Disclaimer

PocketWise AI and any other financial features within our Services are provided for general personal finance tracking, budgeting, and educational purposes only. The application does not provide investment, tax, accounting, legal, or other professional financial advice.

Financial insights, projections, or AI-generated finance coaching offered through our Services are informational only. You should consult a qualified financial advisor before making any financial decisions. NIKKS CREATIONS is not a registered financial advisor, broker, accountant, or fiduciary and assumes no responsibility for financial decisions made based on use of the Services.

10. UPI Payment Disclaimer (PocketWise AI)

PocketWise AI offers a "Pay via UPI" feature that initiates payments by handing off to an installed UPI application on your device. By using this feature, you acknowledge and agree to the following:

• NIKKS CREATIONS is not a payment processor, bank, payment system operator, money transmitter, or financial institution. All actual payment processing is performed by your chosen UPI application, your bank, the National Payments Corporation of India (NPCI), and other intermediaries.
• NIKKS CREATIONS has no control over, and is not responsible for, the success, failure, speed, settlement, decline, reversal, dispute resolution, or fraud detection of any UPI transaction.
• Bank-imposed limits — including but not limited to daily transaction limits, per-payee limits, per-transaction limits, velocity controls, and risk-based holds — are set by your bank and the UPI network. Errors such as "transaction limit exceeded", "insufficient funds", "payee not found", or "transaction declined" are between you and your bank, and PocketWise AI cannot resolve, override, or appeal them.
• You are solely responsible for verifying the correctness of the payee's UPI ID (VPA), name, and amount before initiating any payment. Once funds are sent through a UPI app, NIKKS CREATIONS cannot reverse, cancel, or refund the payment under any circumstances.
• Disputes about any UPI payment — including incorrect transfers, fraud, unauthorised debits, or non-delivery of goods or services purchased — must be raised with your UPI application provider and your bank. NIKKS CREATIONS is not a party to such disputes.
• Because the UPI protocol does not return payment status to the originating application, the expense record you save in PocketWise AI is a manual record made by you. PocketWise AI makes no representation that a saved record corresponds to an actually completed payment.

11. SMS Auto-Capture Disclaimer (PocketWise AI, Android only)

PocketWise AI's optional "Capture bank SMS" feature reads financial SMS messages on your Android device and attempts to parse them into transaction drafts. By enabling this feature, you acknowledge and agree to the following:

• The parser is heuristic. It may miss legitimate transaction SMS, misparse them (extracting wrong amounts, wrong merchants, or wrong transaction types), or incorrectly classify non-financial messages as transactions. These outcomes are inherent to text-pattern parsing and are not defects in the application.
• Captured items are presented as drafts only. They become transactions in your PocketWise AI account only after you explicitly review and confirm each one. You are solely responsible for verifying the accuracy of every draft before confirming it.
• NIKKS CREATIONS is not liable for any financial loss, missed transaction, reconciliation discrepancy, incorrect budget calculation, or downstream decision made on the basis of incorrectly captured, missed, or unreviewed SMS data.
• The SMS listener depends on Android delivering the SMS to your device while the listener is running. Messages received while the device is off, while the listener is restarting, or while the operating system has suspended background processes may not be captured. PocketWise AI does not retroactively backfill missed messages.
• You should treat PocketWise AI as a complement to, not a replacement for, your bank's official statements. Always reconcile your records against your bank's authoritative statements.
• The feature is Android-only and is not offered on iOS. Availability on a given store may depend on platform policies — for example, Google Play Store treats READ_SMS as a restricted permission and may limit availability of the feature on Play Store builds. The feature is available on Galaxy Store builds.

12. App Lock, PIN, and Biometric Disclaimer

PocketWise AI's optional App Lock feature adds a PIN and/or biometric (fingerprint or face) check before opening the app. By using this feature, you acknowledge and agree to the following:

• App Lock is a convenience layer, not a substitute for proper device-level security. You remain responsible for securing your device with a strong screen lock, system-level encryption, and up-to-date software.
• NIKKS CREATIONS does not store your PIN on its servers and cannot recover, reset, or bypass a forgotten PIN on your behalf. If you forget your PIN, you may need to reinstall the app and sign in again, which may make any locally-cached data temporarily inaccessible until cloud re-sync.
• Biometric authentication is provided by the Android operating system. NIKKS CREATIONS has no access to, and cannot guarantee the security of, the underlying biometric subsystem. If biometric authentication is compromised by hardware, firmware, or operating-system vulnerabilities, NIKKS CREATIONS is not responsible.
• App Lock state and any stored PIN are device-local. Uninstalling the app removes the lock, but does not remove any cloud-stored data associated with your account; account deletion follows the process described in our Privacy Policy.

13. Messaging Use Policy

CryptChat is provided as a private communication tool. By using CryptChat, you agree not to:

• Use the Service to engage in illegal activity, including but not limited to harassment, stalking, threats, terrorism, child exploitation, or distribution of unlawful content.
• Send unsolicited bulk messages, spam, scams, or phishing content.
• Impersonate other persons or misrepresent your identity in a way that causes harm.
• Distribute malware, ransomware, or links to malicious content.
• Use the Service to coordinate violence or commit fraud.

We reserve the right to terminate access to CryptChat for any user who violates this policy, to the extent technically possible given the encrypted nature of the platform.

14. Encryption Disclaimer

CryptChat applies cryptographic techniques to messages exchanged between users. While we design our encryption with care, you acknowledge that:

• No security system is perfectly secure, and we cannot guarantee absolute confidentiality or integrity of communications.
• End-to-end encryption means that NIKKS CREATIONS does not have access to the contents of your messages. As a result, we cannot recover lost messages or decrypt content on your behalf.
• If you lose access to your encryption keys, device, or account, your messages may become permanently unrecoverable.
• Security of your device, operating system, and credentials is your responsibility.
• Backups, screenshots, or copies of messages stored outside the encrypted channel are not protected by our encryption.

You assume all risks associated with the use of encrypted messaging features.

15. Intellectual Property

All content, trademarks, logos, branding, source code, designs, graphics, and other materials that form part of the Services are the exclusive property of NIKKS CREATIONS or its licensors, and are protected by intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works of any part of the Services without our prior written consent.

16. User Content

Some features of the Services may allow you to upload, store, or transmit content ("User Content"), including financial entries, workout data, messages, or profile information. You retain ownership of your User Content.

By submitting User Content, you grant NIKKS CREATIONS a limited license to host, store, process, and display that content solely for the purpose of operating and improving the Services. You are responsible for ensuring that your User Content complies with applicable laws and does not infringe third-party rights.

We do not claim ownership of your User Content and will handle it in accordance with our Privacy Policy.

17. Termination

We may suspend, restrict, or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, applicable law, or pose a risk to the Services or other users.

You may terminate your account at any time by uninstalling the applications and following the account deletion process described in our Privacy Policy.

Upon termination, your right to use the Services ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and indemnification) will continue to apply.

18. Limitation of Liability

To the maximum extent permitted by applicable law, the Services are provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or accuracy.

In no event shall NIKKS CREATIONS, its founders, employees, contractors, or partners be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Services, even if we have been advised of the possibility of such damages.

Our total cumulative liability for any claim arising out of or relating to these Terms or the Services shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred Indian rupees (₹100).

19. Indemnification

You agree to indemnify, defend, and hold harmless NIKKS CREATIONS and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use or misuse of the Services; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) your User Content.

20. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in India.

Where required by applicable consumer protection law, the mandatory rights granted to consumers in their place of residence shall prevail.

21. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. The updated version will be posted on this page with a new "Last updated" date. Material changes will be communicated through in-app notification or via the contact information associated with your account.

Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.
